Disclaimers, Limitations, and Exclusions
Warranty Disclaimer
This Limited Warranty is the only express warranty provided by Arctic Campers. No other warranties are implied or extend beyond the terms described herein, except as provided by Australian Consumer Law (ACL). This warranty is granted solely by Arctic Campers and may only be modified by Arctic Campers in writing. This Limited Warranty constitutes the entire and exclusive agreement between the parties and supersedes any prior representations or agreements. Consumers may have additional rights under ACL, which are not affected by this warranty.
Warranty Period
- General Products: This warranty covers a period of 12 months from the date of retail purchase.
- Structural Components: This warranty covers a period of 5 years for structural components, such as drawbars and chassis.
These periods do not affect any rights you may have under ACL, which provides guarantees for a reasonable period based on the nature of the product.
Implied Warranties
Any implied warranties of fitness for a particular purpose or implied warranties of merchantability are limited to the duration of the applicable warranty period under this Limited Warranty.
Exclusions
This warranty does not cover:
- Expendable Parts: Items subject to general maintenance, including wheel bearings, bulbs, filters, tires, and drainage hoses.
- Damages from Normal Use: Damages resulting from natural wear and tear, aging, or neglect.
- Non-Defective Issues: The following are not considered defects in materials or workmanship and are therefore excluded:
- Tires damaged by external punctures.
- Undercarriage damage from contact with rocks or other structures.
- Natural discoloration of materials due to UV exposure.
Owner Responsibilities
To maintain your rights under this warranty, you must follow reasonable care and maintenance practices, including adhering to the prescribed maintenance schedule and proper storage guidelines. If the product shows any failure or damage, you must immediately cease use of the product and have it inspected by an authorized Arctic Campers outlet before further use. Damages arising from improper use, neglect, or failure to follow maintenance instructions will not be covered under this warranty.
Poptop & Annex Limited Warranty
Arctic Campers warrants that the poptop and annex products are free from defects in materials and workmanship under normal use and maintenance from the date of retail purchase, for the applicable Warranty Period. This warranty is non-transferable and applies solely to the original purchaser. Consumer guarantees under ACL may apply to subsequent owners. Certain components, such as zippers, are excluded from this warranty.
Canvas Product Warranty
The warranty period for all canvas products is 12 months from the date of purchase. This warranty covers defects in materials and workmanship but excludes damages arising from external factors, such as storms or improper care (e.g., failure to air out the canvas after exposure to moisture).
Exclusions for Canvas Products
This warranty does not cover:
- Expendable Parts: Such as zippers, mesh, aluminum poles, and screens.
- Damages from External Factors: Including storm damage, improper storage, or UV discoloration.
Australian Consumer Law
Consumers are afforded protection under Australian Consumer Law, part of the Competition and Consumer Act 2010 (Cth). These warranty terms are in addition to, and do not replace, your rights under ACL. In the event of any inconsistency between the express warranty and ACL, the provisions of ACL will prevail.
Our goods and services are provided with guarantees under ACL. Consumers have the right to a remedy for major failures in goods or services. For minor failures, we will rectify the issue within a reasonable time. If the product fails in a manner covered by ACL, you may be entitled to a remedy, including a refund, replacement, or compensation for any loss or damage.
Exclusions
This Limited Warranty excludes general maintenance and consumable parts ("Expendable Parts") such as wheel bearings, bulbs, filters, tires, and drainage hoses, unless a defect in materials or workmanship is present at the time of supply. These exclusions apply solely to the express warranty and do not limit your rights under ACL.
Factory Seconds or Demonstration Products
Items sold as factory seconds, ex-demonstration, or with disclosed defects are sold on an "as is" basis, with no warranty, unless otherwise specified in writing. However, ACL guarantees still apply to such items.
